What is an example of a “direct threat”?
A direct threat is found where an applicant has a history of threats against co-workers and managers on a previous job in the recent past that were followed by escalating incidents involving physical altercations on the job. Applicant was given time off for medical attention, but continued to have violent episodes, including punching a wall onsite and making further threats. Indications are that this employee had not received any further medical treatment. In this instance, this individual poses a direct threat due to his actions and threats and since his prior medical treatment had no positive effect on his behavior and only a couple weeks had elapsed since his last episode.
